Significant Cases and Referrals

Brad Henry and Michael Bogdanow were spotlighted in Lawyer's Weekly in September 2004 for a creative collaborative effort resulting in a $2.5 million dollar settlement for a severely injured jogger. Early one morning, a female jogger was struck from behind by an SUV operating on the wrong side of the road by a newspaper delivery-person. The case involved an imaginative challenge to the law protecting large newspapers and others from the liability of deliverers as "independent contractors," as well as an "Indiana Jones" type investigation in the Brazilian jungle to track down the driver of the SUV, an illegal immigrant who fled the U.S. immediately after the accident. John Carroll and Brad Henry were reported in the December 2004 issue of Lawyers Weekly for an interesting and effective settlement involving a woman who was injured at an amusement park. While attempting to exit her cart at the end of the ride, the woman severely and permanently injured her leg. The case involved out of state defendants, out of country witnesses, and mastery of amusement park liability. See this link for more details.

Recent Noteworthy Settlements

In the year that it settled, according to Massachusetts Lawyers Weekly, our firm's $5.5 million settlement of a case arising from a head-on motor vehicle collision involving the fatigued driver of a fast-food chain vehicle was one of the ten highest settlements. In the accident, a parent and child were severely injured when the driver-employee fell asleep and crossed a highway centerline.

Also highlighted in Massachusetts Lawyers Weekly was the firm's $1.2 million settlement of a case arising from a highly-publicized shooting spree at a Massachusetts college. Our client, a campus security guard, was shot at close range by a disturbed student armed with an assault rifle. The case was brought against the gun shop alleged to have unlawfully sold the weapon, a mail-order ammunition dealer and college administrators who had received information that the student had a gun and was planning to kill someone but failed to contact the authorities or warn campus security.

The firm also reached a substantial settlement on behalf of a child who lost an eye when he was physically assaulted on a school bus by another student. Suit was filed against the student who committed the assault and the school bus company, which allegedly failed to take necessary steps to prevent the incident. The structured settlement will pay the plaintiffs more than $1 million over time.

Medical Malpractice Settlements

A $2 million dollar settlement was reached in a medical malpractice lawsuit on behalf of the estate of a woman who died of colon cancer as a result of her doctor's failure to have her undergo appropriate diagnostic testing.

The firm also obtained a substantial settlement which will pay the plaintiffs more than $1 million over time in another medical malpractice action involving a young woman who died from a system-wide infection stemming from chicken pox. The plaintiffs alleged that the hospital emergency room physicians were negligent in failing to administer antiviral medication to the patient in circumstances where steroids she was taking for an unrelated condition made her more susceptible to infection.
